Copyright law

I'm trying to make an iPhone game. Delayed three months by moving/learning he material/my general laziness. I'm finally in the preproduction state drawing the backrounds. It starts off with a Kidd playing a video game during a storm

I want the kid to be playing a nintendo game cube but Im not sure I can do that (legally) does anyone more versed on copyright law have any words of wisdom for this issue?

Make it in the shape of a cube, use some obscure logo and bam. Averted.

Like if using an apple product, use a pear instead of an apple.

If a song was made in GarageBand can I use it for a game, and how would I protect my rights for it?

Just say it's yours and pick a license. If you see someone else usin it, sue em.

First bit of advice: I'm not a lawyer, and neither is anybody else on this board (as far as I'm aware).

Second bit of advice: Since the console doesn't seem to be an integral part of the story, you might as well replace it with something else.  

Third bit of advice: if you're not planning on making any money off the game, that might make a difference.

I think I'll just make it look like a game cube. And the emac look like an emac (the kid has an emac now? Okay sure why not)
And no one will be sure. And I'll just tell my web designer "yo alex put up something called game secrets or something else I'll probably rip off from nintendo and well tell out loyal viewers 'notice that box yeah that was a game cube... Isn't ur life complete'"
